General terms and conditions

These general Terms and Conditions are applicable to all transactions and deliveries.

Please read these general terms and conditions carefully!
Parts cannot be returned once used. For used and electronic parts no guaranty applies.

All prices are exclusive of VAT and exclude packing and shipping costs.

General Terms and Conditions.

1. Applicability

1.1 For all offers, orders en agreements of Loco Classics, further referred to as “Loco” these General Sales Conditions, hereafter referred to as: “Conditions”, apply, excluding all other conditions. These Conditions are registered at the Chamber of Trade in Eindhoven under reference number 17181619 and may be made available to you by e-mail upon request.
1.2 You agree to accept these Conditions upon acceptance of an offer or by placement of an order from “Loco”.
1.3 Exemptions on the Conditions can only be made in writing and in that case the remainder of the Conditions still apply.
1.4 All rights and claims as written down in these Conditions and all future agreements for Loco Classic Car Parts are also applicable for intermediates and third parties appointed by Loco Classics.

2. Agreements

2.1 An agreement will become valid at the moment that Loco Classics has accepted your order. Loco Classics reserves the right to refuse orders or make deliveries under special conditions, unless specifically stated different. If an order is not accepted, you will be informed within ten(10) working days after receipt of the order.

3. Prices/(Special) Offers

3.1 All offers of Loco Classics are without obligation and Loco Classics always has the right to change prices, especially when this is the result of legal requirements.
3.2 All prices are quoted in Euro’s, excluding VAT and shipping costs.

4.Returned Parts

4.1 Used parts and electronic parts cannot be returned
4.2 You are obliged to check if the home delivered parts are in conformancewith the placed order.
If this is not the case, then you may inform Loco Classics via email, stating the ordernumber in the subject field of your email and a clear statement why the part is not correct. if In case it is clear that you refused the part for valid reasons, then Loco Classics will replace the part, or cancel your payment.
4.3 In the exceptional case that you will receive a part that does not comply with your order, Loco Classics reserves the right to replace this part by a new one or refund you. In this case any shipment costs for the returned goods are for the customer.
4.4 In case you intend to return a part, please comply with the following procedure:

  • Send an e-mail to info@lococlassics.nl to make us aware of your return shipment.
  • ATTENTION!. State the part number and invoice number in the subject header of your e-mail
  • Wrap the part carefully to prevent damage
  • Put the correct address on the package.

5. Payments

5.1 Payment has to be made without reduction or compensation within seven (7) days of date on the invoice within the Netherlands and within fourteen (14) days of the date of invoice if abroad unless other arrangements are agreed on.
5.2 If you exceed the latest date of payment, you will be charged 1% interest per month or part of the month from the day your payment was due over the unpaid amount. If your payment arrives after a reminder by Loco Classic Car Parts you will be charged twenty-two euro’s en sixty-nine euro cents (€22,69) for administration costs. If Loco Classics is forced to collect her claim through the use of a Debt Collecting Agency, you will be charged extra for these costs, which will be at least fifteen (15) % of the unpaid amount, Additionally, Loco Classics reserves the right to charge you for the actual costs.
5.3 Upon failure to pay, Loco Classics reserves the right to postpone or cancel the execution of all related agreements.
5.4 If the prices for the parts and services increase between the date of order and the execution of the order you have the right to cancel the order within ten (10) days of the announcement of the price increase by Loco classics.

6.Delivery

6.1 The delivery times indicated by Loco Classics can only be regarded as an estimate. Exceeding these delivery times neither gives the right for compensation nor gives it the right to cancel your order. Only when the actual delivery time is such that it becomes clear that you cannot be reasonably expected to stick to the agreement will you have the right to cancel the order and or the agreement insofar it is deemed necessary.
6.2 The delivery of the products will take place as soon as the products are ready for delivery.

7. Reservations on ownership

7.1 The exchange of ownership of delivered products will take place when you have satisfied all the conditions of the agreement with Loco Classics. The responsibility for the products starts on delivery.

8. Claims and liability

8.1 You are obliged to check if the products meet your requirements on delivery. If not, you are obliged to inform Loco Classics in writing as soon as possible, but at a latest three (3) days after delivery
8.2 If proven that the product does not meet the requirements of the agreement, Loco Classics reserves the right to replace the relevant product(s) or refund you.

9. Electronic communication and prove

9.1 Loco Classics can not be held liable for any misunderstanding, corruption, delay or incorrect relay of data and messages resulting from of the use of Internet or any other means of communication between the customer and Loco Classics (or any other party acting on behalf of Loco Classics), unless Loco Classics can be proven wrong due to intentional and grave negligence.
9.2 Where the customer challenges the existence, content or execution of the order through legal action, the administration of Loco Classics can be regarded as a complete certificate of the existence, content and execution of the agreement with the customer.

Force Majeur

10.1 In Force Majeur situations, and irrespective of any other rights, Loco Classics reserves the right to unilaterally postpone or cancel the execution of the relevant orders without further legal action. This will be done by informing you of this in writing and Loco cannot be held liable for any costs relating to this action with the exception of where this is deemed reasonably unacceptable.
10.2 Force Majeur situations may be defined as situations where Loco cannot be held responsible for the situation, either through legal, lawful or normal trade restrictions and accepted standards.

11.Miscellaneous

11.1 When one or more articles of these Conditions or any other agreement with Loco Classics is not in compliance with the relevant legal act, that article will be deleted and replaced by a new article drafted by Loco Classics in reference to the accepted rules and regulations.
11.2 Loco Classics reserves the right to use a third party to execute the order.

12 Applicable law and appropriate judge

12.1 In all legal situations regarding transactions, rights, obligations, offers, orders and agreements between Loco Classics and any other party only Dutch law and legal procedures apply.
12.2 All legal conflicts between related parties will only be subject to Dutch Law and will be dealt with in by an appropriate court in The Netherlands.
